Service Agreement

This Service Agreement establishes the parameters governing your access to and utilization of our installation utility and related applications (referred to as the "Installation Tool" and "Application").

Your engagement with these offerings ("End User," "you," or "your") constitutes acceptance of this Agreement, creating a binding contract with our organization ("Provider," "we," "us," or "our").

Property Rights & Application

The Installation Tool and Application constitute proprietary assets of the Provider, whether created internally or obtained through licensing arrangements. This Agreement governs how you engage with the Installation Tool and Application, encompassing all related capabilities and operations.

Acceptance & Authorization

Through the act of installing and operating the Application, you verify that you have examined, comprehended, and consented to this Agreement. You pledge to observe all applicable legal requirements and regulations. Should you reject this Agreement, you are obligated to discontinue use and remove the Application from your device.

Our service delivery may necessitate gathering and handling information about your Application usage patterns. We advise examining our Privacy Statement prior to continuing.

Installation Tool & Application Operations

Upon accessing our offerings—whether through product download or installation—you authorize us to deploy the Application along with any supporting elements. Operating the Application may require system alterations, encompassing modifications such as registry adjustments and internet connectivity. Consequently, when you engage with and utilize the Application, your browser configuration may be modified, potentially establishing an alternative default search provider. Such modifications could affect queries initiated through the location bar, homepage, or new tab interface, potentially routing these queries to an alternate search platform. Be aware that removing or uninstalling the Application will not automatically reinstate your prior browser configuration; should you desire to restore your previous search provider, homepage, or new tab settings, manual adjustment through your browser's configuration interface will be necessary. Throughout the installation sequence, additional elements may be offered, which you may approve, bypass, or refuse. The process can be halted using provided controls; nevertheless, abrupt termination might leave behind residual components requiring manual deletion. By advancing with installation, you consent to establishing PDFly as your default search provider and accepting any associated conditions specified within this Agreement.

Authorization & Usage Parameters

The Provider extends to you a restricted, non-exclusive, non-assignable, cancellable authorization to deploy and operate the Application exclusively for individual, non-revenue-generating activities. Any rights not expressly provided herein are retained by the Provider.

External Materials

The Application may contain external materials, encompassing query results, promotional content, or third-party websites. We neither regulate nor validate such materials and disclaim responsibility for any engagement with external resources.

End User Obligations

Through Application usage, you commit to refrain from:

• Reproducing, disseminating, renting, marketing, sublicensing, or monetizing the Application.
• Altering, decompiling, disassembling, or interfering with the Application's operations.
• Compromising protective measures or circumventing access limitations.
• Deploying harmful code, participating in deceptive conduct, or breaching applicable regulations.
• Contravening this Agreement through any means.

Non-compliance may trigger access suspension or cancellation, accompanied by potential legal ramifications.

Proprietary Rights

All proprietary rights, encompassing trademarks, application code, capabilities, alterations, and exclusive technology, remain solely with the Provider and its licensing partners.

Warranty Exclusion

The Application is delivered "in its current state" and "as accessible." The Provider extends no guarantees, whether explicit or implicit, concerning functionality, suitability for specific applications, or fault-free performance. You bear complete responsibility for Application usage.

Liability Restrictions

Within the fullest scope authorized by law, the Provider and associated entities bear no responsibility for indirect, incidental, or consequential losses. Maximum liability for any assertion shall not surpass $10 or any sum remitted for the Application, whichever amount is lesser.

Application Revisions

The Provider may deploy updates, improvements, or alterations to the Application at its determination. Through Application usage, you authorize automatic updates, with the Provider bearing no responsibility for resulting modifications.

Agreement Conclusion

Either party maintains the right to conclude this Agreement at any moment. Following conclusion, you must remove the Application, with all provided authorizations becoming void.

Liability Protection

You consent to defend and protect the Provider, its associated entities, and representatives against any assertions, losses, or obligations stemming from your Agreement violation.

Agreement Revisions

We maintain authority to revise this Agreement at our determination. Revisions take effect following publication. Ongoing Application usage indicates acceptance of modifications.

Additional Stipulations

Should any stipulation be declared unenforceable, the remaining Agreement provisions shall continue in effect.

Legal Framework & Conflict Resolution

This Agreement operates under Israeli legal jurisdiction. Conflicts shall be adjudicated within Tel Aviv courts. Assertions must be submitted within twelve months or face permanent preclusion.

Transfer & Enforcement Discretion

You cannot delegate this Agreement. The Provider retains authority to transfer its rights and duties. Non-enforcement of any stipulation does not represent a waiver.

Exceptional Circumstances

We bear no liability for service disruptions attributable to circumstances outside our reasonable control.
